Privacy Policy

Sanwin Beachwear B.V. (Kieler Bocht 15C, 9723 JA Groningen, the Netherlands, Chamber of Commerce 62592033) is responsible for the personal data we process through sanwinbeachwear.com. This page explains what we collect, why we collect it and what your rights are. You can reach us at info@sanwinbeachwear.com.

What we collect and why

• Your order. Your name, address, email address and, if you provide it, your phone number, so that we can process and deliver your order, handle an exchange or return and keep you informed. Legal basis: performance of the contract. Without your name, address and email address we cannot deliver your order.
• Your account. If you create an account, we keep your details and order history so that you can view them. Legal basis: performance of the contract.
• Your questions. When you email us, we use your message and contact details to answer you. Legal basis: performance of the contract or our legitimate interest.
• The contact form. We protect it against spam with Google reCAPTCHA; Google receives information such as your IP address. Legal basis: our legitimate interest in a form without spam.
• Our newsletter. Your email address and what you viewed and bought with us, so that we can send you emails that suit you. Legal basis: your consent or, if you have ordered from us, our legitimate interest. You can unsubscribe at any time through the link in every email.
• The site and advertising. With your consent, we measure how the site is used and tailor advertising to you. Legal basis: your consent. If you do not consent, Google does not load on our shop pages. Only in the checkout (checkout.sanwinbeachwear.com) does Google still receive a cookieless signal that a page was viewed. Legal basis for that: our legitimate interest in a general picture of visits.
• Legal obligations. We keep order and invoice data for the Dutch tax authorities. Legal basis: a legal obligation.

Who we share it with

We share only what is needed, with parties that work on our behalf: Afosto (our e-commerce platform, including checkout, your account and the emails about your order), Pay.nl (your payment), PostNL and DHL (delivery) and Klaviyo (the newsletter). If you pay with PayPal, PayPal processes your payment under its own privacy policy. With your consent in the cookie banner, we also use Google Analytics, Meta and Google Ads, and Klaviyo remembers which products you viewed. We do not sell your data.

Data outside the European Economic Area

Klaviyo, Google and Meta are (also) based in the United States. If your data goes there, this is on the basis of the EU-US Data Privacy Framework (the adequacy decision of the European Commission of 10 July 2023) or the standard contractual clauses of the European Commission. You can request a copy of these safeguards at info@sanwinbeachwear.com.

Cookies

Some cookies are needed for the site, your suitcase and checkout to work; we always place those. We keep your choice in the cookie banner for one year. Cookies for statistics (Google Analytics) and marketing (Klaviyo, Meta and Google Ads) are placed only with your consent. They stay until they expire, after two years at most, or until you delete them. You can change your choice at any time through Cookie settings at the bottom of every page.

How long we keep it

No longer than necessary. We keep order and invoice data for seven years, as Dutch tax law requires. Account data stays until you ask us to delete your account. We keep your emails for as long as we need them to handle your question or complaint. We use your newsletter email address until you unsubscribe; after that we keep it only to make sure we send you no more newsletters. Statistics in Google Analytics are deleted after fourteen months.

Your rights

You may ask us to see, correct or delete your personal data, to restrict its use or to receive a copy so that you can pass it on. You may object to any use based on our legitimate interest, and to the newsletter at any time. If you gave consent, you can withdraw it at any time; what we did before then remains lawful. Email info@sanwinbeachwear.com and we will respond within one month. If you believe we are not handling your data properly, you can file a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) or, if you live in the European Union, with the data protection authority in your own country.

Security

Our site uses an encrypted connection, and access to personal data is limited to the people who need it for their work.

Changes

We update this policy when our way of working changes. The latest version is always on this page.
